5女兵打靶耳鳴退訓 她提國賠結果慘敗

台北一名林姓女子,2018年加入憲兵接受志願役新兵訓練,卻因在步槍實彈射擊時造成耳鳴而主動申請退訓,她怒向國防部要求國賠51萬元,台北地院審理後,認為林女打靶時耳塞脫落遺失,不能歸咎部隊幹部失職,因此認為林女訴求無理,判她敗訴。
林女提告主張,2018年加入憲兵學生第一大隊第三中隊,成為2018年第7梯次志願役士兵入伍生,在憲兵訓練中心受訓,同年12月11日,她隨部隊到新北市林口區南勢埔靶場進行步槍實彈射擊訓練,行軍途中不慎遺失耳塞。

林女認為當時部隊幹部沒盡責監督、檢查她有無佩戴耳塞,事後她向輔導長報告,輔導長也沒幫她向上級反映以便做相應處理,害她左耳受到音響性外傷而損失聽力,因此認為部隊幹部有疏失,要求國賠51萬元。
台北地院審理時,軍方反駁林女指出,打靶前再三提醒學兵若身體不舒服,要立刻反映,值星官在靶場也反覆詢問學兵有沒有忘記戴耳塞,林女一句話都沒說;法官認為,林女在靶場不反映自己沒戴耳塞,就算教官說過「敵人來了,不會管你有沒有戴耳塞」,也不能用來減免個人責任,更不能歸咎部隊幹部失職,因此認為林女訴求無理,判她敗訴,全案可上訴。
